Comes with The DPCM 27 April 2010 the new model of environmental statement, the one used in Dpcm December 2, 2008 and be used for the deadline of 30 April 2010.
DPCM April 27, 2010, entitled "Changes in the design of unique environmental statement was published in the Official Gazette of April 28, 2010, then two days before the deadline for submission of the Mud.
The decree, which entered into force on the day of publication (because it is not a regulation), replaces the original forms traveled by Prime Ministerial Decree 2008 and shall be used in the wording of the measure, the statements to be submitted with riferimento all’anno 2009 (articolo 1) “entro il termine stabilito dalla legge” (e quindi entro il 30 aprile 2010, ex legge 70/1994).
Segnaliamo che tuttavia nel testo dei nuovi allegati mancano quelli cartacei, ci sono solo i tracciati multi record. Lo stesso decreto stabilisce che rimangono comunque valide le dichiarazioni presentate entro la sua pubblicazione sulla Gu (dunque 28 aprile 2010) avvalendosi dell’originaria modulistica prevista dal Dpcm 2 dicembre 2008.
Si ritiene però che il nuovo Dpcm 27 aprile 2010 possa presentare profili di illegittimità alla luce di quanto previsto dal comma 2-bis, articolo 6, della legge 70/1994 (istitutiva del Mud), which states that "If you have to make, in the year following the year of reference, changes and additions to the single model of the environmental statement, the above changes and additions are (...) to be published in the Official Journal before the date of 1 March. "
An unfortunate situation to which it can therefore be remedied only with a measure of higher rank, as a decree-law enacted emergency or otherwise an act of legislative force.
