Con L’articolo 1 comma quinquies della legge 26 marzo 2010 n. 42, in sede di conversione del Decreto legge 25 gennaio 2010 n. 2, il legislatore ha introdotto all’art. 2 della Legge 23 dicembre 2009 n. 191 il comma 186 bis che prevede:
“Decorso un anno dalla data di entrata in vigore della presente legge, sono soppresse le Autorita' d'Ambito territoriale di cui agli articoli 148 e 201 del decreto legislativo 3 aprile 2006, n. 152, e successive modificazioni. Decorso lo stesso termine, ogni atto compiuto dalle Autorita' d'ambito territoriale e' da considerarsi nullo. Entro un anno dalla data di entrata in vigore della presente legge, regions already granted under the law functions' performed by the Authority ', in accordance with the principles of subsidiarity', differentiation and adequacy. The provisions of Articles 148 and 201 of Legislative Decree n. 152 of 2006 in each region shall be effective until the date of entry into force of Law in the previous period. The same items are still deleted after one year from the date of entry into force of this Act "
Therefore, according to the arrangement shown, one year after entry into force of Law 42/2010 (28 March 2010): 1) The Area Authority will be deleted, and 2) any act done by them (read including legitimate expectations!) will be considered null and 3) the regions must allocate the functions performed by such authorities.
The introduction of a paragraph 186 states, therefore, the definitive disappearance of the ATO which had already been announced by the legislature with the budget law for 2008 (see art. 2, paragraph 38 of Law No. 244 of December 24, 2007) remained largely unrealized until regulatory intervention mentioned.
